These Terms of Use (“Terms”) govern your access to and use of the website located at tasautospa.com and any related pages, social channels, forms, or online tools (collectively, the “Site”), operated by Tas Autospa Inc, doing business as Tas Autospa (“Company,” “we,” “us,” or “our”). By using the Site, booking a service, submitting a form, or paying an invoice, you agree to these Terms.
If you do not agree, do not use the Site or our services.

2) Eligibility & Local Service Area
You must be the vehicle owner or have legal authority to authorize detailing services. We primarily serve Kitchener-Waterloo-Cambridge and surrounding areas; mobile service availability may vary.
3) Website Use
You agree to use the Site lawfully. Do not attempt to disrupt the Site, collect data without permission, or infringe our intellectual property. We may suspend access for suspected misuse.
4) Quotes, Pricing & Changes

Quotes/Estimates: Online quotes are estimates only. Final pricing may vary based on actual vehicle condition, size, contamination, pet hair, salt stains, and add-ons selected at the appointment.

Price Changes: We may update prices, packages, promotions, or Site content at any time.

Taxes: Prices are before applicable taxes. HST will be applied to invoices.

Errors: We may correct typographical or pricing errors and cancel or adjust affected bookings.
5) Bookings, Deposits & Cancellations

Booking: A booking is confirmed when you receive a confirmation notice.

Deposits: For services over $500, a 40% deposit is required at booking.

Refunds/Cancellations:

100% refundable if cancelled 48 hours before the scheduled service.

80% refundable if cancelled within 24 hours of the scheduled service.
-
70% refundable if cancelled within 1 hour of the scheduled service.

<1 hours, no-show, or vehicle unavailable: deposit may be non-refundable and a rescheduling fee may apply.

Rescheduling: Subject to availability and weather (for mobile).

Late Arrival: May reduce service time or require rebooking.
6) Payments
We accept [Visa/Mastercard/Amex/e-Transfer/Cash]. Payment is due upon completion unless otherwise stated in writing. Unpaid amounts may accrue interest at the maximum rate permitted by Ontario law. We reserve all lawful remedies to recover unpaid fees.
7) Vehicle Preparation & Personal Items

Remove personal belongings before your appointment. We do not open sealed items or handle valuables.

Items left may be treated as refuse and discarded during cleaning.

We are not responsible for lost, stolen, or damaged items left in the vehicle.

A clutter/personal-item removal fee (minimum $25) may apply if we must clear the cabin or trunk to proceed.
8) Condition Disclosure & Risk Acknowledgment
Detailing involves chemicals, water, steam, brushes, clay, and machine polishing where applicable. By authorizing work, you acknowledge:

Hidden or pre-existing conditions (clear coat failure, thin or brittle paint, micro-cracks, oxidation, failing trim, loose emblems, weak seals, prior bodywork, aged plastics, electrical issues, aftermarket wraps/PPF) can limit outcomes or worsen during normal, careful procedures.

Some stains, odours, etching, or scratches may be permanent or only partially improved.

Matte/satin finishes, gloss-black wheels, piano-black plastics, soft-touch surfaces, and sensitive infotainment screens require special care; we may decline certain corrections if risk is high.

Water runoff may occur during washing; ensure suitable drainage and permission to use water/power for mobile service.

Child seats will not be uninstalled/reinstalled by our staff for safety reasons.
9) Damage & Liability
We take reasonable care and follow industry-standard methods. We are not liable for:

Pre-existing damage; wear/tear; prior poor repairs; failing clear coat; latent electrical/mechanical issues; or damage arising from unsafe conditions.

Aftercare performed by you or third parties, including automatic car washes that may inflict swirls/marring.

Indirect, incidental, special, punitive, or consequential damages (e.g., loss of use).
Liability cap: to the fullest extent permitted by Ontario law, our total liability is limited to the amount you paid for the specific service giving rise to the claim.
10) Service Outcomes, Warranties & Aftercare

No Guarantee of Perfection: Detailing is restorative/cosmetic; full defect removal is not always possible.

Coatings/Sealants: Any stated durability (e.g., years of protection) assumes proper prep, cure, and customer aftercare (hand-wash method, pH-appropriate soaps, no harsh chemicals). We may provide written aftercare instructions; following them is your responsibility.

Warranty: Only written warranties expressly provided by us at purchase apply. Otherwise, services are provided “as is” to the extent permitted by law.
11) Photos & Media
With your permission, we may take before/after photos or short videos of your vehicle (license plates blurred) for quality control. And portfolio/marketing. You may withdraw consent at any time for future use by emailing us.
12) Mobile Service Requirements (if applicable)
For mobile appointments, you confirm you have permission to use the location and that it is safe, legal, and accessible, with adequate space, lighting, and [water/power] if required. Appointments may be rescheduled due to weather or site conditions.
13) Prohibited Conduct on the Site
Do not:

Upload malicious code, scrape, or reverse-engineer the Site;

Infringe intellectual property;
-
Post unlawful, defamatory, hateful, or abusive content;

Misrepresent identity or misuse booking/contact forms.
We may remove content or restrict access to protect users and the Site.
14) Intellectual Property
All Site content (text, graphics, logos, photos, videos, icons, code) is owned by us or our licensors and protected by Canadian and international IP laws. You may view and print pages for personal use only. No other license is granted.
15) User Content & Reviews
If you submit reviews, testimonials, images, or messages (“User Content”), you grant us a non-exclusive, royalty-free license to use, reproduce, and display that content for Site operation and marketing, subject to our Privacy Policy and your rights under applicable law. You represent you own or control the rights to any content you submit.
16) Gift Cards, Promotions & Third-Party Offers
Promotions, coupons, and gift cards are subject to additional terms stated at issuance. Third-party offers/links are provided “as is”; we are not responsible for third-party sites, privacy practices, or claims.
17) Privacy, Cookies & Electronic Messages
Your use of the Site is also governed by our Privacy Policy. We use cookies/analytics to improve the Site. By opting-in, you consent to receive electronic messages under Canada’s Anti-Spam Legislation (CASL); you can unsubscribe at any time.
18) Accessibility
We aim to make our Site and services accessible and to comply with the Accessibility for Ontarian's with Disabilities Act (AODA). And related standards. For accommodations or feedback, contact us at [accessibility@yourdomain.com].
19) Compliance & Consumer Rights
Nothing in these Terms limits your non-excludable rights under applicable law, including the Consumer Protection Act, 2002 (Ontario). Where any term is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue in effect.
20) Indemnity
You agree to indemnify and hold harmless the Company, its owners, employees, and contractors from claims, losses, and expenses (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your misuse of the Site; or (c) your violation of laws or third-party rights.
21) Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including weather, power outages, labour disputes, supply issues, or internet failures.
22) Governing Law & Disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws rules.

Venue: Courts located in Waterloo Region, Ontario shall have exclusive jurisdiction, except for small claims which may be brought in Small Claims Court.

Resolution First: Please contact us to attempt informal resolution before pursuing formal action.

23) Changes to the Site or These Terms
We may update the Site or these Terms at any time. Changes take effect when posted with a revised “Last Updated” date. Continued use after changes means you accept the new Terms.
24) Termination
We may suspend or terminate access to the Site or decline service if you breach these Terms or where safety, legality, or payment concerns arise.
25) Entire Agreement
These Terms, together with any service-specific work orders, estimates, invoices, or written warranties. And our Privacy Policy, constitute the entire agreement regarding your use of the Site and our online booking processes.
